Terms of Service

Last updated: 29 October 2026

These Terms of Service (“Terms”) apply to orders placed through the Pengilly Landscapes online store at www.pengillylandscapes.co.uk. Please read them before placing an order.

Our website provides information about our landscaping and garden care business and offers a selection of garden tools for purchase online. These Terms primarily govern online product purchases. Separate terms may apply to landscaping services where agreed with a customer.

Nothing in these Terms affects any statutory consumer rights that cannot lawfully be excluded or restricted.

1. About Us

The website is operated under the name Pengilly Landscapes.

Address: Alwoodly House, Burnhams Rd, Great Bookham, Leatherhead KT23 3BA, United Kingdom

Email: info@pengillylandscapes.co.uk

Phone: +44 1372 456700

If Pengilly Landscapes is a trading name rather than the legal name of the business operating the store, the full legal business name should also be provided in the appropriate business details.

2. Who Can Buy

You must be legally capable of entering into a contract to place an order. If you are under 18, you should have permission from a parent or guardian before making a purchase.

Certain products may be subject to specific legal age restrictions. Where a restriction applies, we may request appropriate age verification and may decline or cancel an order if the legal requirements cannot be met.

3. Products and Descriptions

We aim to provide accurate descriptions, images and specifications for the products listed in our online store.

Product appearance may vary slightly because of screen settings, lighting or manufacturing variations. Dimensions, materials and other specifications are provided to help customers make an informed choice.

If a product is materially different from its description or does not meet applicable legal requirements, your statutory consumer rights remain unaffected.

4. Prices

Prices are displayed in pounds sterling (GBP). Applicable taxes and delivery charges will be shown during checkout in accordance with the store's pricing and tax settings.

We take reasonable care to ensure that prices are accurate. If we discover a genuine pricing error before dispatch, we will contact you to explain the issue. Where an order cannot be supplied at the displayed price, we will give you the option to proceed at the corrected price or cancel for a refund of any payment collected.

We will not use a pricing error to remove rights you have under applicable law.

5. Placing an Order

When you submit an order, you are making an offer to purchase the selected products.

We will send an order acknowledgement to the email address you provide. This acknowledgement confirms that we have received your order; it does not necessarily mean that the order has been accepted.

We may be unable to accept an order because of product availability, a genuine pricing or listing error, suspected fraudulent activity, or another legitimate reason. If we cannot fulfil an order for which payment has been collected, we will notify you and arrange a refund as appropriate.

We will communicate any material issue with your order using the contact details you supplied.

6. Payment

Payment is processed using the payment methods available at checkout. These may include supported debit and credit cards and Shop Pay, depending on availability.

The timing of payment authorisation and collection depends on the payment provider and payment method.

For further information about accepted payment methods, pricing and refunds, please see our Payment Policy.

7. Delivery

We currently deliver to addresses within the United Kingdom.

Orders are generally processed within 1–2 working days. Delivery typically takes a further 5–6 working days after dispatch. These are estimates, and actual delivery times may vary.

Standard UK delivery is free on orders of £50 or more. Orders below £50 are subject to the delivery charge displayed at checkout.

We will provide available tracking details when your order is dispatched.

If a delivery is delayed or a problem arises, please contact us so we can help. Your statutory rights relating to delivery and non-delivery remain unaffected.

Responsibility for the goods generally passes to you when you, or someone you nominate, takes physical possession of them, subject to applicable law.

For further details, please see our Shipping Policy.

8. Cancellation and Returns

You may have a statutory right to cancel an online purchase within 14 days of receiving the goods, without giving a reason. If you exercise this right, you generally have a further 14 days to return the goods.

We also offer a voluntary 30-day return period for eligible items, subject to our Refund & Return Policy. The voluntary policy does not replace or reduce your statutory rights.

To notify us of a cancellation or request a return, contact info@pengillylandscapes.co.uk and include your order number. You may notify us of a statutory cancellation by making a clear statement of your decision within the applicable period.

Refunds, return postage and any permitted deductions will be handled in accordance with applicable law and our Refund & Return Policy.

9. Faulty, Damaged or Incorrect Items

Products must meet the requirements of applicable consumer law, including being of satisfactory quality, fit for purpose and as described.

If an item arrives damaged, faulty or incorrect, please contact info@pengillylandscapes.co.uk with your order number and a description of the problem. Photographs may help us assess the issue.

Depending on the circumstances and your statutory rights, you may be entitled to a repair, replacement, price reduction or refund. We will explain the available options and arrange appropriate next steps.

Nothing in these Terms limits your statutory rights in relation to faulty goods.

10. Safe Use of Garden Tools

Our online store includes garden tools that may have sharp edges or moving parts.

Please read and follow the manufacturer's instructions, use appropriate protective equipment, and keep tools safely stored away from children. Choose tools suitable for the intended task and inspect them before use.

Product descriptions and general guidance on our website are not a substitute for the manufacturer's safety instructions or professional advice where needed.

Nothing in these Terms excludes liability for injury, damage or other matters where such exclusion is prohibited by law.

11. Liability

We are responsible for losses or damage that you suffer where we are legally responsible, including where required by applicable consumer law.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

Where the law permits, we are not responsible for losses that were not reasonably foreseeable when the relevant contract was formed or for losses arising from use of a product in a manner contrary to its instructions. This does not affect your statutory consumer rights.

12. Website Content and Intellectual Property

Unless otherwise stated, content on this website, including text, logos, photographs and design elements, belongs to Pengilly Landscapes or is used with permission.

You may access and use the website for personal, lawful purposes. You must not reproduce or commercially reuse website content without permission from the relevant rights holder, except where permitted by law.

13. Events Outside Our Reasonable Control

Sometimes events outside our reasonable control, such as severe weather, transport disruption or supply interruptions, may affect our ability to fulfil an order on time.

If such an event affects your order, we will take reasonable steps to inform you and explain the available options. This section does not remove any rights or remedies you may have under applicable law.

14. Governing Law

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to you under the law.

Nothing in this section prevents a consumer from relying on mandatory rights or bringing proceedings in a court where the law permits.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, products or legal requirements.

The version applicable to your order will be the version in force when the order is placed, unless a change is required by law or otherwise agreed with you.

16. Contact Us

If you have a question about these Terms or an order, please contact us.
